1. Conclusion of the Contract
A binding travel contract is concluded upon receipt of the customer’s written booking request by email, letter or fax and becomes legally binding only after the agency has issued a written booking confirmation and invoice. The person making the booking is the contractual partner of the agency and is also responsible for all additional participants included in the booking.
2. Payment
Once the travel contract has been concluded, the customer will receive a booking confirmation together with an invoice for the booked services. The required deposit becomes due upon receipt of the invoice. The remaining balance is generally payable no later than 30 days before the start of the trip.
For bookings made within 30 days prior to departure, the total travel price must be paid in full.
Failure to make payments on time releases the agency from any obligation to provide the booked services.
3. Services
The contractual services are those specified in the relevant booking confirmation. The services listed therein are binding for the agency.
However, the agency expressly reserves the right to make justified, significant and unforeseeable changes to the published descriptions, particularly those published online, prior to the conclusion of the contract. Customers will be informed immediately before the contract is concluded.
Any verbal agreements extending the scope of services beyond those stated in the booking confirmation require written confirmation by the agency in order to be valid.
Bringing your own food or beverages on board is strictly prohibited. For exclusive charters, the Open Bar (non-alcoholic) package is mandatory for all participants.
Unless otherwise stated in the quotation, all legally required music licence fees (SGAE) are included in the charter price, with the exception of the Barca Samba.
4. Payment and Cancellation Terms
4.1 Katamaran Magic
- 50% deposit upon booking
- Remaining balance due 30 days before the excursion
- If the excursion cannot be safely carried out due to weather conditions, as determined solely by the captain, no cancellation fees will apply to the charter. Ordered catering remains payable.
- Cancellation up to 91 days before departure: 10% of the total invoice
- 90–61 days before departure: 25%
- 60–31 days before departure: 35%
- 30–19 days before departure: 65%
- 18–0 days before departure: 100% (additional conditions may apply if stated in the quotation)
- Final participant numbers and catering orders must be confirmed in writing no later than 25 days before the excursion.
- Changes within 24 days before departure are subject to a €60 administration fee per change request. No changes are possible within 4 days before departure.
4.2 Katamaran Oasis
- 50% deposit upon booking
- Remaining balance due 35 days before departure
- If cancelled due to unsafe weather conditions as determined by the captain, no cancellation fees apply to the charter. Catering already ordered remains payable.
- Up to 91 days before departure: 25%
- 90–31 days before departure: 50% of the charter price. Food and beverage deposits are refunded in full.
- 30–16 days before departure: 100% of the charter price. Food and beverage deposits are refunded in full.
- 15 days or less before departure: 100% of the total invoice including all booked services.
- Final participant numbers and catering must be confirmed 25 days before departure.
- Shoes are not permitted on board the catamaran.
4.3 LifeandSea
- 50% deposit upon booking
- Remaining balance due 30 days before departure
- If cancelled due to unsafe weather conditions, no cancellation fee applies to the charter. Ordered catering may be served at another location chosen by the customer.
- Up to 40 days: 10%
- 39–20 days: 60%
- 19–0 days: 100%
- Participant numbers and catering must be confirmed 25 days before departure.
4.4 Rafael Verdera
- 50% deposit upon booking
- Remaining balance due 30 days before charter
- Weather cancellations decided by the captain are free of charge for the charter. Food and beverages remain payable.
- 185+ days: 15%
- 184–95 days: 25%
- 94–65 days: 50%
- 64–0 days: 100%
- Participant reductions:
- Reductions notified at least 10 calendar days before the event may be accepted provided they do not change the agreed price category.
- No refunds are available for participant reductions notified less than 10 days before the event.
4.5 Barca Samba
- 50% deposit upon booking
- Remaining balance due 14 days before departure
- 65+ days: 20%
- 64–15 days: 50% of the charter price and booked extras. Food and beverage deposits refunded in full.
- 14–0 days: 100% of the total invoice.
4.6 If the captain cancels the excursion due to unsafe weather conditions, an alternative date may be offered. If this is not possible, the charter amount will be refunded. Food and beverages already ordered are excluded and may be served either on board in the harbour or at another agreed location.
4.7 Other vessels and shared excursions may be subject to separate payment and cancellation conditions.
5. Special Conditions for Sailing Regattas
- Participation is based on approximately nine participants per yacht.
- The yacht owner may adjust the number of boats provided if sufficient space remains available for all participants.
- Bookings are made by the organiser or a designated representative on behalf of all participants.
- The contract becomes valid once the quotation has been accepted and confirmed.
- Participants must follow all safety instructions throughout the event.
- The captain alone decides whether weather conditions allow the regatta to take place.
- If cancelled for safety reasons, catering is cancelled free of charge.
- A cancellation charge of 30% applies to all remaining services.
- The remaining amount will either be refunded or credited towards a new date.
6. Changes
Minor changes to the booked services are permitted if they become necessary after the contract has been concluded and do not substantially affect the overall nature of the booked arrangements. Customers will be informed immediately and, where appropriate, offered a free rebooking or cancellation.
7. Complaints
Any complaints must be reported immediately in writing to the tour leader or agency representative during the activity. Collective complaints submitted after the event will not be accepted.
8. Liability
Claims must be submitted within one month after the contractual end of the trip and must have been reported on site during the activity.
Descriptions provided by third-party suppliers are based on the information supplied by those providers.
We are not liable for differences between customer expectations and the services provided, nor for external disturbances such as traffic, aircraft, entertainment venues, roadworks, beach pollution or interruptions to electricity or water supplies caused by weather conditions.
Please note that, for insurance reasons, independently booked activities may not be combined with a charter booked through our agency.
9. Prices
All prices shown on this website are final prices including all applicable taxes and charges under the Spanish special VAT scheme for travel agencies (Margin Scheme). VAT is therefore not shown separately on invoices.
10. Passport, Visa and Health Requirements
Customers are responsible for complying with all passport, visa and health requirements applicable when travelling to Spain.
11. General Provisions
Should any provision of these Terms and Conditions become invalid, the validity of the remaining provisions shall remain unaffected.
The place of jurisdiction and performance is Palma de Mallorca.
